At least in England. According to the english newspaper The Herald a man named Nigel Roberts sued the company Media Logistics (UK) Ltd which sent him unwanted emails.
He was able to take actions under the Directive on Privacy and Telecommunications, a European Union law allowing spam victims to claim damage.
It seems he recieved only two mails from the company which he first tried to contact asking for an apology and claiming damages. He further asked for information stored about himself and the way his email made it into their database. They refused and a judge ruled in favor of Mr. Roberts.
