At least in England. According to the English newspaper The Herald a man named Nigel Roberts sued the company Media Logistics (UK) Ltd which sent him unwanted emails.
He was able to take actions under the Directive on Privacy and Telecommunications, a European Union law allowing spam victims to claim damage.
It seems he received only two mails from the company which he first tried to contact asking for an apology and claiming damages. He further asked for information stored about himself and the way his email made it into their database. They refused and a judge ruled in favor of Mr. Roberts.
Both parties agreed for an settlement in which the company had to pay Mr. Roberts the sum of 270 pounds for his damages and 30 pounds for his claim fee. I just did a quick calculation of my spam mails per day (around 500) which would bring me to 67500 pounds daily.
The most interesting aspect of this story is the consequence that this ruling could have on companies that send out spam mails. You may send spam to the wrong person that will sue you.
